San Joaquin County Probate & Trust Attorney

If you are handling an estate in Stockton, Tracy, Manteca, or anywhere else in San Joaquin County, the first thing to know is that probate is no longer heard in Stockton. The court moved its probate departments to Lodi in 2025, and older forms, websites, and advice may still point to the wrong place.

Lamash Legacy Law is based in Malibu. I represent executors, administrators, trustees, and beneficiaries in probate and trust matters before the Superior Court of California, County of San Joaquin, appearing remotely where the court allows and in person when the matter requires it. I handle every case personally, in English.

Where San Joaquin Probate Is Heard

Effective February 3, 2025, San Joaquin County probate matters are heard at the court’s Lodi locations:

  • Department L2, 315 West Elm Street, Lodi, CA 95240
  • Department L1, 217 West Elm Street, Lodi, CA 95240 (probate matters only)

Your notice of hearing must show the correct department and address. If a notice still lists a Stockton courtroom, it should be corrected before it is served.

Probate notes and filing deadlines

San Joaquin’s probate examiners review petitions and post probate notes approximately 10 to 15 days before the hearing. Under the court’s guidance, responses to the notes should be filed at least one week before the hearing; otherwise the matter may be continued. That leaves only a few days between the posting of notes and the filing target, so preparation matters.

Zoom appearances: the court’s rules

The probate departments allow remote appearances by Zoom, with specific rules: video is required, participants should log in at least 15 minutes early or risk missing the roll call, display their first and last name, and may not record the proceeding. For law-and-motion matters, tentative rulings are posted by 1:30 p.m. the court day before the hearing.

I appear remotely in San Joaquin County whenever the court allows, which helps keep costs down for clients.

San Joaquin Estate Issues

Farmland, vineyards, and the Delta

San Joaquin County is one of California’s major agricultural counties, with orchards, row crops, Delta farmland, and the vineyards around Lodi. Proposition 19 keeps a parent-child property tax exclusion for family farms, subject to an indexed value cap. Each legal parcel should be reviewed before transfer, because qualifying and non-qualifying parcels are treated differently.

Commuter households and Bay Area heirs

Many San Joaquin residents moved from the Bay Area to Tracy, Mountain House, Manteca, or Lathrop, and their families may live in several counties. Probate is opened in the county where the decedent lived. If the decedent also owned property in another county or a rental back in the Bay Area, that property is administered in the same San Joaquin case. For decedents who lived outside California, ancillary probate may be needed.

When there is no will

When someone dies without a will, California’s intestacy rules decide who inherits. A surviving spouse or registered domestic partner receives the decedent’s share of community property and a share of separate property; the rest passes to children, then parents, then siblings. The right to serve as administrator follows a statutory order of priority, starting with the surviving spouse.

Smaller estates

For deaths on or after April 1, 2025, a California primary residence worth up to $750,000 can be transferred by a simplified court petition, and personal property up to $208,850 can often be collected by affidavit. Many San Joaquin County estates may fit these thresholds, which can avoid full probate administration.
