Sacramento Probate & Trust Attorney
Sacramento estates often include a few things that are less common elsewhere: a state pension and retiree benefits from a career in public service, a family home in a neighborhood the family has lived in for generations, and relatives who are more comfortable in another language. I can help with all of these.
Lamash Legacy Law is based in Malibu. I represent executors, administrators, trustees, and beneficiaries in probate and trust matters before the Superior Court of California, County of Sacramento, appearing remotely where the court allows and in person when the matter requires it. I work with every client personally, in English.
The Sacramento Probate Court
Probate in Sacramento County is not heard at the downtown courthouse. The court’s Family Law and Probate Divisions are housed at the William R. Ridgeway Family Relations Courthouse, 3341 Power Inn Road, Sacramento, CA 95826, and probate matters are heard in Department 129.
Probate calendar notes
In Sacramento, the court’s probate attorneys review every petition and proposed order before the court acts on it, and they publish probate calendar notes listing any legal deficiencies. The notes are ordinarily available about 10 days before the hearing and can be viewed by case on the court’s Public Portal. Where the notes say something is “needed,” the petitioner has to respond, usually by filing a supplement or amendment that complies with the court’s local rules. Responsive pleadings must be filed at least five days before the hearing to be considered.
Ten days is not much time. The most reliable way to avoid a continuance is to file a petition that does not generate notes in the first place, and to check the portal as soon as notes are published. I do both.
Remote appearance in Department 129
Department 129 offers remote appearance by Zoom. A party who wants to appear remotely must file a Notice of Remote Appearance (Judicial Council form RA-010) by the court’s deadline, which is shorter for non-evidentiary hearings and longer for evidentiary ones. Missing that deadline can mean appearing in person or losing the hearing date.
Sacramento Estate Issues
Pensions and retiree benefits
Many Sacramento residents retire with a public pension. Survivor benefits and payments to named beneficiaries generally pass outside of probate, under the plan’s rules, but they still need to be claimed, and they affect how the rest of the estate is divided. Final pension payments, unpaid benefits, and retiree health coverage for a surviving spouse should be addressed early in the administration.
Family homes and the simplified procedures
For deaths on or after April 1, 2025, a successor can petition the court to transfer a decedent’s California primary residence without full probate if its gross value does not exceed $750,000. In parts of Sacramento County, that procedure may be available where it would not be in coastal counties. It applies only to the primary residence, not to rental property, and other assets still have to fit within their own limits. Determining whether a simplified procedure works can save months.
When no one can agree
Sibling disputes over who should serve as administrator, whether to sell the house, or whether a parent’s late-life will reflects their true wishes are common. When the facts suggest undue influence or lack of capacity, a will or trust contest may be appropriate. When a trustee simply will not share information, beneficiary rights remedies, including a petition to compel an accounting, are available.

I represent clients in Sacramento, Elk Grove, Folsom, Citrus Heights, Rancho Cordova, Carmichael, and across Sacramento County. For matters in neighboring counties, the case belongs in that county’s Superior Court; I can explain where your matter should be filed. Statewide information on thresholds and statutory fees is on my California probate attorney page.
