Stanislaus County Probate & Trust Attorney

In Stanislaus County, many estates involve an almond or walnut orchard, a dairy, a farmhouse on acreage, or a family home in Modesto, Turlock, or Oakdale that has stayed in the family for decades. Probate here is often about keeping farmland and family property in order across generations, and about doing it without avoidable delays.

Lamash Legacy Law is based in Malibu. I represent executors, administrators, trustees, and beneficiaries in probate and trust matters before the Superior Court of California, County of Stanislaus, appearing remotely where the court allows and in person when the matter requires it. I handle each case personally, in English.

The Stanislaus County Probate Court

Probate filings in Stanislaus County are handled by the Probate Unit in the Civil Clerk’s Office, 801 10th Street, 4th Floor, Modesto. According to the court, probate hearings are held Tuesday through Friday at 8:30 a.m.

The court’s Probate Division covers decedents’ estates, trusts, conservatorships, and guardianships, and it also hears elder and dependent adult abuse restraining orders.

The probate examiner and public notes

In Stanislaus County, the probate examiner reviews every probate matter set for hearing, including ex parte applications, and makes the examiner’s notes available to the public. The notes list missing items such as notice defects, missing declarations, or bond issues. The court provides an email address for examiner questions, but the solution to a note is almost always a filed document, not a conversation.

Lodge the will within 30 days

California Probate Code §8200 requires anyone holding a decedent’s original will to deliver it to the clerk of the Superior Court within 30 days after learning of the death. In Stanislaus County, wills are lodged with the Probate Unit. Lodging the will is required even when no probate case is expected, and it is often the first step a family should take.

Conservatorships

The court’s materials explain that a conservatorship hearing is generally set about 45 to 60 days after the petition is filed, and that proposed conservators must obtain the court’s Conservator’s Handbook. A court investigator interviews the proposed conservatee before the hearing. Planning around that timeline matters when a parent needs help quickly.

Stanislaus County Estate Issues

Orchards, dairies, and Proposition 19

Proposition 19 kept a parent-child property tax exclusion for family farms as well as family homes, subject to an indexed cap. Orchards and dairies can be high-value assets, so each legal parcel should be reviewed to see whether it qualifies and whether the cap applies before the property is distributed or sold.

Running a farm during probate

Crops still need water, harvest, and sale while an estate is open. Under the Independent Administration of Estates Act, an executor with full authority can take many actions without a court hearing, using a Notice of Proposed Action to beneficiaries. When family members disagree about selling or operating the farm, the court can resolve it.

When heirs disagree about the farm

When one heir wants to keep farming and others want to sell, the options include a buyout, a sale during probate, distribution in undivided shares, or, as a last resort, partition. Choosing a direction early, with every heir informed, can prevent a contest later.

Smaller estates

For deaths on or after April 1, 2025, a California primary residence worth up to $750,000 may transfer by simplified court petition, and personal property up to $208,850 can often be collected by affidavit. These procedures may save many Stanislaus County families the cost of full probate administration.
