Kern County Probate & Trust Attorney

Kern County estates often include assets that city estates rarely have: farmland, oil and gas royalties, mineral rights, and agricultural equipment, alongside a family home in Bakersfield. These assets need to be identified, valued, and transferred correctly, and royalty income does not stop because someone has died.

Lamash Legacy Law is based in Malibu. I represent executors, administrators, trustees, and beneficiaries in probate and trust matters before the Superior Court of California, County of Kern, appearing remotely where the court allows and in person when the matter requires it. I handle each case personally, in English.

The Kern County Probate Court

Kern’s Probate Department is not located at the downtown civil courthouse. It is at the Juvenile Justice Center, 2100 College Avenue, Bakersfield, CA 93305. Probate-related questions about examiner notes can be directed to the probate examiners, whose contact details are listed on the court’s Probate page.

Examiner notes and “Not Ready for Hearing”

Kern’s probate examiners review petitions before hearing and post their notes on the court’s online portal, where they appear under the case’s Events and Hearings. A matter with unresolved issues is marked “Not Ready for Hearing.” Those issues are cleared by filing a verified supplement, on pleading paper, that addresses each item in the notes.

The most effective approach is to prevent notes in the first place: correct notice to all heirs, proper publication, and accurate bond and inventory information. When notes appear anyway, a prompt, specific supplement is usually what keeps the hearing on track.

Remote appearances

Whether a Kern probate hearing can be attended remotely depends on the type of hearing and the court’s current rules, and the court can require a personal appearance. I confirm the format before each hearing and appear remotely when the court allows it.

Kern County Estate Issues

Oil, gas, and mineral interests

Kern County is one of California’s leading oil-producing counties, and many local families hold mineral rights or royalty interests, sometimes inherited across generations and sometimes in fractional shares. In probate, these interests must be listed, appraised by the probate referee, and transferred so the operator will pay royalties to the right person. If royalty checks remain in the decedent’s name, payments may be suspended until the paperwork is complete.

Farmland and Proposition 19

Farmland is a major Kern County asset. Proposition 19 kept a parent-child exclusion for family farms, subject to an indexed value cap, in addition to the family home. Agricultural property that does not qualify may be reassessed when transferred. Whether a parcel qualifies, and how to handle the cap, should be reviewed before the property is distributed.

Real property in more than one county

Many Kern families also own property elsewhere. Probate is opened in the county where the decedent lived. If the decedent lived outside California but owned Kern property, ancillary probate may be needed in Kern County.

Farm debts and creditor claims

Farm operations often carry equipment loans, crop financing, and lines of credit. In probate, creditors generally must file claims within the later of four months after letters are issued or 60 days after notice is mailed to them. The executor reviews each claim and allows or rejects it. Secured lenders must be paid or otherwise dealt with before encumbered land or equipment is sold or distributed, and a farm that keeps operating during probate needs a clear record of income and expenses for the final accounting.
